Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the website at getparceldata.com (the “Site”), the GetParcelData API (the “API”), and any data products, datasets, or services we make available (collectively, the “Services”), provided by IT Services Lukasz Jocz, operating as GetParcelData (“GetParcelData,” “we,” “us,” or “our”).
By using the Services, creating an account, or purchasing a dataset, you agree to these Terms. If you do not agree, you must not use the Services.
1. Eligibility & accounts
You must be at least 18 years old and have the authority to enter into a binding contract. If you are using the Services on behalf of a company, you represent that you are authorized to bind that company. You are responsible for the security of your account credentials and API keys, and for all activity that occurs under them.
2. The Services
GetParcelData aggregates publicly available parcel and property records published by US county and state GIS authorities, normalizes them into a unified schema, and licenses access to the resulting datasets via downloadable files and the API. We may add, remove, or change features at any time. We do not guarantee that any specific county, field, or dataset will be available or remain available, since upstream sources are outside our control.
3. License & permitted use
Subject to your payment of applicable fees and ongoing compliance with these Terms, GetParcelData grants you a non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the data you have purchased for your internal business purposes, including incorporating derived insights into your own products and services.
You may not:
- Resell, redistribute, sublicense, or publish the raw datasets as a standalone product or in bulk;
- Use the data to build a competing parcel-data aggregation, lookup, or resale service;
- Use the data for unlawful purposes, including stalking, harassment, or violation of any person’s privacy or property rights;
- Use the data to make decisions about consumer eligibility for credit, insurance, employment, or housing in a manner that would make it a “consumer report” under the US Fair Credit Reporting Act (FCRA);
- Reverse engineer the API, attempt to derive source code, or circumvent rate limits, authentication, or other technical controls.
All right, title, and interest in and to the Services, including all intellectual-property rights in our schema, normalization logic, software, and aggregated outputs, remain with GetParcelData. Underlying public records remain governed by the open-data licenses of their originating jurisdictions.
4. Fees, billing & taxes
Fees are quoted on a per-order or subscription basis. Payments are processed by Stripe; by submitting payment information you agree to Stripe’s terms. Subscription fees are billed in advance and are non-refundable except as stated in Section 5. Quoted fees are exclusive of any applicable taxes, duties, or withholdings, which are your responsibility. We may change pricing on prospective renewals with at least 30 days’ notice.
5. Refunds & cancellation
One-time data purchases may be refunded within 14 days of delivery if the dataset is materially defective (e.g. substantial missing coverage versus what was advertised at time of purchase) and we are unable to remediate within a reasonable time. Refunds are not available for data already used in production or downloaded in full.
Subscriptions may be cancelled at any time from your account or by emailing contact@getparceldata.com. Cancellation takes effect at the end of the current billing period; fees paid for the current period are not refunded except where required by applicable consumer-protection law.
To request a refund, contact contact@getparceldata.com with your order number. We respond to refund requests within 5 business days.
6. Acceptable use
You agree not to:
- Scrape, crawl, or otherwise extract data from the Services other than through documented endpoints;
- Share API keys, accounts, or licensed datasets with third parties;
- Probe, scan, or test the vulnerability of the Services without our written permission;
- Interfere with the Services, e.g. through denial-of-service traffic or malicious code;
- Use the Services in violation of export controls or applicable sanctions.
We may suspend or terminate your access immediately if we reasonably believe you have violated this section.
7. Data accuracy & “AS IS” disclaimer
The Services aggregate data from many third-party government sources of varying quality and timeliness. We make commercially reasonable efforts to normalize and validate the data, but the Services and all data are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express, implied, statutory, or otherwise — including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, or uninterrupted availability. You are responsible for evaluating whether the data is fit for your intended use.
8. Limitation of liability
To the maximum extent permitted by law, GetParcelData’s total cumulative liability arising out of or relating to the Services or these Terms shall not exceed the fees you paid us in the 12 months preceding the event giving rise to the claim, or USD 100 if you have not paid any fees. In no event will we be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or for lost profits, revenues, goodwill, or data, even if advised of the possibility of such damages.
9. Indemnification
You agree to defend, indemnify, and hold harmless GetParcelData and IT Services Lukasz Jocz from any third-party claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Services, your violation of these Terms, or your violation of any third-party right.
10. Termination
You may stop using the Services at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if continued provision becomes commercially unreasonable. Upon termination, your license to use the data ends; payment obligations accrued through the termination date survive, as do Sections 3 (final sentence), 7, 8, 9, 11, and 12.
11. Governing law & disputes
These Terms are governed by the laws of Poland, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods. The competent courts of Poland will have exclusive jurisdiction, except that either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual-property rights. Where mandatory local consumer-protection law applies to a consumer-user, that law prevails over this section to the extent of any conflict.
12. Changes & miscellaneous
We may update these Terms from time to time; material changes will be posted on this page with a new “Last updated” date and, for active customers, announced by email. Continued use of the Services after changes take effect constitutes acceptance. If any provision of these Terms is held unenforceable, the remainder will remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and GetParcelData regarding the Services.
